Florida Fellow Michael Petruccelli recently obtained a Plaintiff’s verdict in a case filed in Polk County, Florida, against a local hospital. The case involved a claim for retaliatory discharge in violation of the Florida Whistleblower Statute. In this case, Plaintiff, the hospital’s licensed healthcare risk manager, claimed that she was wrongfully terminated after objecting to unlawful conduct on the part of her employer, Heart of Florida Regional Medical Center, concerning the nursing care of LPN’s which was outside the scope of their practice. After a five day trial, the jury found in favor of the Plaintiff and awarded damages in the amount of one million dollars. The damage award consisted of damages for lost wages and lost fringe benefits, as well as non-economic damages as well. The Plaintiff is also petitioning the Court to award damages for front pay for future wage loss. The case was heard by County Court Judge Sharon Franklin in the 10th Judicial Circuit of Polk County.
